Tow Away Privacy Policy

TowAway App - Towing and Roadside Assistance Service, which facilitates Towing & Roadside assistance services, communication and logistics between Motorists & Service Providers. The Owner of the TowAway App, TowAway (Pty) Ltd, a private company established in the Republic of South Africa, under company registration number (2018/516800/07).

(hereinafter “we” or “us” refers to the TowAway-App owners)

Service Provider - A Company or Individual registering to provide Towing or Roadside Assistance Services via the TowAway Platform.

Operator - Persons/employees/service providers factually providing tow service or roadside assistance

operating on behalf of Tow provider, may also be an individual registered in own capacity.

Motorist - Person requesting Tow or Roadside Assistance services.

Users - Any persons using the TowAway App.

When you use TowAway you trust us with your personal data in as far as legally bound by the Protection of Personal Information Act in the Republic of South Africa which provides that everyone has the right to privacy, including the right to protection against the unlawful collection, retention, dissemination and use of personal information.

1. Scope

This notice applies to TowAway users across the Republic of South Africa and the personal data we collect, how it is used and shared, across all our online platforms (Mobile App, Website or any other features or services).

Service Providers

Name, Identity document, E-mail, Phone Number 

Company Name, Company Registration, VAT Registration (103i Certificate)

Vehicle Information (Vehicle Ownership, Roadworthy Certificate)

Operator Information (Name, Identification such as Drivers licence)

Geo-location and Driving Routes

Payment/Banking Information

Proof of Address (Storage Facility)

Operators

Vehicle Information

2. Purposes of the processing and data collected

Data provided to TowAway during account creation, data created during the use of our App or other

platforms.

We collect and process personal data for the purpose of ensuring that service providers & operators can complete towing or roadside assistance services effectively and efficiently once they have been

connected to motorists.

Geo-location and driving routes are processed to analyse geographical area of accidents and also to provide accurate quotes to motorists for services.

Driver’s licence, identity documents, vehicle information in order to ensure compliance with legal requirements and suitability of the operator providing service.

TowAway App displays the operators name, vehicle and company details to motorists to identify the person or entity providing service.

Ratings of the operator are necessary to ensure that motorists are comfortable receiving services from reliable service providers.

3. Legal

Personal data is processed for the completion of the services requested by the motorist from Service Providers.

The pre-requisite for the use of the TowAway App is the processing of vehicle information, geolocation data and Service Provider information.

In addition to the above, personal information may be processed and/or shared with third parties such as law enforcement regarding criminal convictions or offenses or any pending legal disputes in order to comply with legal obligations.

4. Service Providers

Your personal data is only disclosed to motorists who request a service from you, and whose quote has been sent by the operator, in addition to being accepted by the motorist. Motorists will see operator's name, Company they represent, Vehicle registration, phone number, and geolocation data. Motorists can also service provider detail on the receipt received after the service has been provided.

Processing of personal data will occur under the same conditions as established in this privacy policy.

5. Motorists

Your personal data is only disclosed to operators who are available to provide the service at the time requested by you, whose quote has been sent & accepted by you. Service Provider will see Motorist name, vehicle description, phone number, and geolocation data. Service providers will be able to process motorist’s personal detail made available on the receipt received after the service has been provided.

6. Security and access

Any personal data collected in the course of providing services is transferred to and stored.

Only authorised employees TowAway partners have access to the personal data and they may access the data only for the purpose of resolving issues associated with the use of the services (including disputes).

Processing Motorist personal data

You may not process the personal data of motorists without the permission of us. You may not contact any motorist or collect, record, store, grant access, use or cross-use the personal data provided by the motorist or accessible to you via the TowAway app for any reason other than for the purposes of fulfilling the towing or roadside assistance services or resolving any disputes.

Processing Tow Service Providers Personal Data

As a motorist you may not process the personal data of tow service providers. You may not contact any tow service provider or collect, record, store, grant access, use or cross-use the personal data provided by the tow service provider or accessible to you via the TowAway App for any reason other than for the purposes of fulfilling the towing or roadside assistance services, or resolving a dispute.

You must comply with the rules and conditions for processing of personal data of passengers as set forth in the Privacy Policy. If you violate the requirements for the processing of personal data, we may terminate your account and claim damages from you.

7. Access, correction, retention, deletion and data portability

Personal data can be viewed and corrected on the TowAway App.

Your personal data will be stored as long as you have an active account. If your account is closed the personal data will be stored for additional 3-year period.

Data necessary for accounting purposes shall be stored for 5-years.

In the event of suspicions of an administrational or criminal offence, fraud or false information, the data shall be stored for 10 years.

In the event of disputes, the data shall be retained until the claim is satisfied or the expiry date of such claims.

We respond to the request for deleting and transferring personal data submitted by an e-mail within a month and specify the period of data deletion and transfer.

Disputes relating to the processing of personal data are resolved through TowAway support
